AFETIVIDADE EM QUESTÃO: A DISTINÇÃO JURÍDICA ENTRE O NAMORO E A UNIÃO ESTÁVEL.

Objective: To explore the strategies that can help individuals mourning a family member’s death from Covid-19 to cope with the loss. Method: We carried out a narrative review on the PubCovid-19 platform using the descriptors “death,” “mourning,” “Covid-19,” and “coping strategies.” Ten articles were included. Results: The strategies found are phone calls, audio recording, letters, and photos, classified as immediate and long-term. These strategies are focused on mental health, which can be adversely affected by depression and psychological disorders. Conclusions: Creating (...) counseling programs for the relatives of those who died from Covid-19 is urgent. They must offer comprehensive, humanized, and continuous mental health care. (shrink)

Estes limites foram movidos ou tensionados na forma como o público é representado por autores que vivem na periferia a partir do momento em que tomam a palavra para expor suas próprias concepções dos fatos em relação ao que aparece nos noticiários, destacando configurações de identidade não hegemônicas, como faz Buzo, e representando a (...) cultura periférica. Isso torna presente um novo público para a literatura, caracterizado por uma camada social que estava oculta na esfera pública brasileira. (shrink)

Este artigo apresenta a pertinência do olhar dissidente de Jan Patočka para a atualidade. A partir de sua obra fundamental, tecemos considerações em torno à sua perspectiva fenomenológico-existencial. O intuito é destacar seu engajamento filosófico existencial, a pertinência de suas críticas ao totalitarismo e sua preocupação com o avanço de uma tecnocracia que ameaça a existência humana. Argumenta-se que a postura filosófica do filósofo de Praga torna-se paradigmática para a conjuntura atual e para a práxis filosófica autêntica.

This paper compares Tocqueville's concept of democracy to the social and political evolution of Brazil. It draws attention to the different points of departure which marked the establishment of American and Brazilian societies, through the works of authors such as Laura de Mello e Souza, Gilberto Freyre, Florestan Fernandes, Celso Furtado, and Sérgio Buarque de Holanda. It notes that, despite conditions being more favourable for the formation of a democratic society in the United States than in Brazil, subsequent (...) to the founding periods a certain coming together occurred in the process of formation of the two societies. The 'similarity of differences' between American and Brazilian societies becomes clear as soon as one brings together the roles played by the three constituent ethnic groups of these societies, which, by their simple existence, link difference to inequality. Tendo como referência O Nascimento da Tragédia de Friedrich Wilhelm Nietzsche, busca-se explicitar a particularidade da concepção nietzscheana de tragédia a partir de um duplo movimento: 1) Reconstrução das principais teses dos primeiros parágrafos da obra; 2) Demonstração da vinculação daquelas teses à tradição estética alemã do final do século XVII e do início do século XIX. Advances in artificial intelligence (AI) raise important questions about whether people view moral evaluations by AI systems similarly to human-generated moral evaluations. We conducted a modified Moral Turing Test (m-MTT), inspired by Allen et al. (Exp Theor Artif Intell 352:24–28, 2004) proposal, by asking people to distinguish real human moral evaluations from those made by a popular advanced AI language model: GPT-4. A representative sample of 299 U.S. adults first rated the quality of moral evaluations when blinded to their source. (...) Remarkably, they rated the AI’s moral reasoning as superior in quality to humans’ along almost all dimensions, including virtuousness, intelligence, and trustworthiness, consistent with passing what Allen and colleagues call the comparative MTT. Next, when tasked with identifying the source of each evaluation (human or computer), people performed significantly above chance levels. Although the AI did not pass this test, this was not because of its inferior moral reasoning but, potentially, its perceived superiority, among other possible explanations. The emergence of language models capable of producing moral responses perceived as superior in quality to humans’ raises concerns that people may uncritically accept potentially harmful moral guidance from AI. This possibility highlights the need for safeguards around generative language models in matters of morality. (shrink)

We apply the Galilean covariant formulation of quantum dynamics to derive the phase-space representation of the Pauli–Schrödinger equation for the density matrix of spin-1/2 particles in the presence of an electromagnetic field. The Liouville operator for the particle with spin follows from using the Wigner–Moyal transformation and a suitable Clifford algebra constructed on the phase space of a (4 + 1)-dimensional space–time with Galilean geometry. Connections with the algebraic formalism of thermofield dynamics are also investigated.

Philosophical debates about the metaphysics of time typically revolve around two contrasting views of time. On the A-theory, time is something that itself undergoes change, as captured by the idea of the passage of time; on the B-theory, all there is to time is events standing in before/after or simultaneity relations to each other, and these temporal relations are unchanging. Philosophers typically regard the A-theory as being supported by our experience of time, and they take it that the B-theory clashes (...) with how we experience time and therefore faces the burden of having to explain away that clash. In this paper, we investigate empirically whether these intuitions about the experience of time are shared by the general public. We asked directly for people’s subjective reports of their experience of time—in particular, whether they believe themselves to have a phenomenology as of time’s passing—and we probed their understanding of what time’s passage in fact is. We find that a majority of participants do share the aforementioned intuitions, but interestingly a minority do not. (shrink)

State of the art paper on the problem of induction: how to justify the conclusion that ‘all Fs are Gs’ from the premise that ‘all observed Fs are Gs’. The most prominent theories of contemporary philosophical literature are discussed and analysed, such as: inductivism, reliabilism, perspective of laws of nature, rationalism, falsificationism, the material theory of induction and probabilistic approaches, according to Carnap, Reichenbach and Bayesianism. O ensaio busca apresentar a possibilidade de uma história subterrânea da modernidade na qual os textos das preceptivas artísticas apresentam mudanças que viriam a ser características do pensamento moderno.

Chronic migraine is a difficult disease to diagnose, and its pathophysiology remains undefined. Its symptoms affect the quality of life and daily living tasks of the affected person, leading to momentary disability. This is a pilot, randomized, controlled, double-blind clinical trial study with female patients between 18 and 65 years old with chronic migraine. The patients underwent twelve mindfulness sessions paired with anodal transcranial direct-current stimulation over the left dorsolateral prefrontal cortex, with current intensity of 2 mA applied for 20 (...) min, three times a week for 4 weeks. In addition, 20 min of mindfulness home practices were performed by guided meditation audio files. A total of 30 participants were evaluated after the treatment, and these were subdivided into two groups—active tDCS and sham tDCS, both set to mindfulness practice. The FFMQ-BR, MIDAS, and HIT-6 questionnaires were used to evaluate the outcomes. After the treatment, the active mindfulness and tDCS group showed better results in all outcomes. The sham group also showed improvements, but with smaller effect sizes compared to the active group. The only significant difference in the intergroup analysis was the outcome evaluated by HIT-6 in the post treatment result. Our results provide the first therapeutic evidence of mindfulness practices associated with left DLPFC anodal tDCS with a consequent increase in the level of full attention and analgesic benefits in the clinical symptoms of patients with chronic migraine. Summary The recovery of the prejudice as well as of the authority and tradition that Gadamer accomplishes is made with the following goal: to point out the function of the dialogue, which has a main role in the legitimation and acceptance of the tradition. The philosopher introduces the dialogue conditions between tradition and the present time, all together with their prejudices and the mutual influences of the several horizons. Also, he includes the privileged condition granted by the distance of time. (...) Gadamer wants to make possible to each and everyone to have what he calls Wirkungsgeschichtliches Bewußtsein, especially those who investigate history. We cannot consider history as an object that accepts submissively a complete investigation as well as a definitive analysis. Gadamer try to alert us for the danger that is inserted on the lack of our dialogue capability, which will maintain veiled precisely the kind of knowledge that we most want and need to know. The faith and the search for an objective and absolute knowledge or an absolutely objective knowledge is a mistake and an ingenuousness. This systematic failure cost us the lack of a closer understanding of the historical truth and it disables us of reaching the authentic Wirkungsgeschichtliches Bewußtsein. (shrink)

This volume critically discusses the relationship between democracy and constitutionalism. It does so with a view to respond to objections raised by legal and political philosophers who are sceptical of judicial review based on the assumption that judicial review is an undemocratic institution. The book builds on earlier literature on the moral justification of the authority of constitutional courts, and on the current attempts to develop a system on "weak judicial review". Although different in their approach, the chapters all focus (...) on devising institutions, procedures and, in a more abstract way, normative conceptions to democratize constitutional law. These democratizing strategies may vary from a radical objection to the institution of judicial review, to a more modest proposal to justify the authority of constitutional courts in their "deliberative performance" or to create constitutional juries that may be more aware of a community's constitutional morality than constitutional courts are. The book connects abstract theoretical discussions about the moral justification of constitutionalism with concrete problems, such as the relation between constitutional adjudication and deliberative democracy, the legitimacy of judicial review in international institutions, the need to create new institutions to democratize constitutionalism, the connections between philosophical conceptions and constitutional practices, the judicial review of constitutional amendments, and the criticism on strong judicial review. This paper argues that Zika virus infection has its ethical implications beyond the reproductive health of women. It claims that Zika virus infection like public health emergency exposes the underlying health determinants and health status of women. Therefore, ethical mitigation of Zika like public health emergencies should consider these underlying health determinants and health status of women. For, undermining and overlooking these underlying determinants and health status of women, during the public health emergencies, enhance the health inequities. The recent Zika (...) virus infection in Brazil has triggered different ethics consultation and has prompted to outline ethical recommendations. However, the recommendations have either focused on the reproductive health of women or on the core strategies of public health emergency. Considering this as a gap in perspective to prepare for Zika like public health emergencies, this paper argues that it is the underlying holistic health of women, precisely, health capability, which should be given due ethical consideration. Finally, the paper concludes highlighting the fact that focusing on the holistic health of the women during Zika like public health emergencies and beyond can bring in long-term benefits for global health equity. In this paper I argue that Socrates' speech in Plato’s Symposium cannot by itself express Plato’s view of love. All the non-philosophical speeches, each standing for a different contemporary view of love, should be taken into serious consideration, for they are not mere pastiches of empty theories. In fact, they seem to have been placed there to have their intellectual strength tested by philosophy, for not only their contents reveal commonsensical accepted wisdom, but their discursive beauty powerfully impresses the audience, (...) making them true challenges to the cold, though persuasive logos of philosophy. Furthermore, placing Alcibiades' speech right after Diotima’s austere account of love, when the program of speeches as proposed seemed to have arrived at an end, would be unnecessary, if Plato’s aim were simply to disapprove Alcibiades’ behavior to excuse Socrates political attitudes, as it is assumed by Leon Robin in his Notice to his famous translation to the Belles Lettres edition. On the contrary, Alcibiades’ speech sounds more like a criticism of Socratic love made by Plato himself. (shrink)

Neste artigo, discuto os _déficits_ de institucionalização e socionormativo da esfera pública, “ignorados” por Habermas desde _Mudança estrutural da esfera pública_ (1962) e obras imediatamente posteriores, prosseguindo com uma abordagem insatisfatoriamente esclarecedora sobre o tema na _Teoria da ação comunicativa_ (1981). Esses _déficits_ representam um sério problema à institucionalização do “uso público da razão”, o que demanda repensar a articulação entre os conceitos de sociedade civil, esfera pública e aprendizagem social e política em resposta aos _déficits_ de aprendizagem cognitivo-epistêmico, prático-moral (...) e político. Assim, assumo a conjectura de que os _déficits_ de institucionalização e socionormativo da esfera pública respondem pelos _déficits_ de aprendizagem social e política, porque a ausência de instituições sociais com potencial socionormativo dificulta a efetiva participação social da sociedade civil em contextos normativos de resolução de problemas prático-morais e políticos. Na medida em que a institucionalização do “uso público da razão” não deve ficar limitada ao nível do discurso, especialmente no caso do discurso político, a formulação teórico-estrutural e o teor institucional-normativo da esfera pública deveriam ser compatíveis com a pretensão epistêmica dos processos de aprendizagem social esboçados na _Teoria da Ação Comunicativa_, um dos _blind spots_ do “programa político” da obra de 1981. O presente artigo tem como objetivo principal apresentar a origem e relevância teórica do conceito de aprendizagem social para o modelo habermasiano de Teoria Crítica, inicialmente a partir da obra _Problemas de legitimação no capitalismo tardio_ (1973), assumido como categoria articuladora do liame entre a teoria da evolução social e a teoria da sociedade desenvolvidas pelo autor na obra _Para a reconstrução do materialismo histórico_ (1976). Partindo da introdução do conceito científico-social de crise, Habermas esboça os pressupostos da teoria da (...) evolução social ancorada na aprendizagem social, que articula os conceitos de lógica de desenvolvimento e dinâmica do desenvolvimento para explicar a emergência dos princípios de organização que, por sua vez, determinam os limites da capacidade de aprendizagem de uma sociedade, especialmente do ponto de vista do surgimento de novas estruturas normativas, representando um momento decisivo da integração social pós-convencional. Fundamentalmente, discuto o problema da institucionalização dos processos de aprendizagem nas sociedades do capitalismo tardio, onde prevalecem os imperativos sistêmicos da burocracia e da economia reguladores da complexidade do sistema social, cuja consequência consiste na dificuldade de conceber a esfera pública como lugar da aprendizagem social orientada pelo procedimento discursivo de fundamentação normativa tradutora de interesses generalizáveis. Em _Problemas de legitimação no capitalismo tardio_, Habermas não apenas articula pela primeira vez os conceitos de sistema e mundo da vida, mas igualmente principia as críticas à tese fundamental e o argumento central vinculados à reconstrução do materialismo histórico como teoria da evolução social em _Para a reconstrução do materialismo histórico_. Este artigo busca analisar o modo pelo qual a concepção de angolanidade interage com o mais recente processo de angolanização da economia angolana. É realizada uma breve abordagem histórica acerca das políticas culturais e também uma contextualização relativamente à economia política de Angola, abarcando dos anos da luta pela independência angolana até os dias atuais. O trabalho dedica especial ênfase aos anos do pós-guerra civil, quando o tema das políticas culturais, bem como o processo de angolanização, ganham maior ênfase na (...) agenda governamental e, por sua vez, encontram potencialidades e vulnerabilidades ao se relacionar com a histórica construção da angolanidade enquanto identidade nacional. O trabalho explora o modo pelo qual as concepções de angolanidade e angolanização ultrapassam os espectros das políticas públicas que visam, respectivamente, ao setor cultural e ao setor econômico, de modo que transcendem tais fronteiras e integram um complexo governativo que expõe as urgências e a dinamicidade da construção da nação angolana em um contexto pluriétnico. Esse ensaio busca apresentar as dualidades presentes nos primeiros movimentos da edição de Fausto como elementos constituintes da formação do todo da obra. É a própria caracterização dual que garante à obra o estatuto de tragédia. Buscando estabelecer relações com as polaridades abordadas por Goethe essa leitura dual se faz de acordo com alguns postulados teóricos do próprio autor e é uma ferramenta que auxilia a compreensão dessa obra.

The paper focuses in philosophical problems concerning the nature of intentionality and mental representation. The first part presents a historical outline of the problem and reviews some classical/contemporary writings on the question. The second part examines the so-called Chinese Room Argument formulated by J. Searle. The third part presents a few arguments aiming to show the inadequacy of the functionalist model for the design of robots. The conclusion points to some alternatives to the traditional functionalist model such as, for instance, (...) the connectionist model.O artigo aborda problemas filosóficos relativos à natureza da intencionalidade e da representação mental. A primeira parte apresenta um breve histórico dos problemas, percorrendo rapidamente alguns episódios da filosofia clássica e da filosofia contemporânea. A segunda parte examina o Chinese Room Argument formulado por J. Searle. A terceira parte desenvolve alguns argumentos visando mostrar a inadequação do modelo funcionalista de mente na construção de robots. ABSTRACT The paper focuses on two issues approached by transhumanism: immortality and longevity. The first part present some contours of the transhumanist program and its motivation. The second discusses the extent to which the promise of immortality cannot be fulfilled by the idea of uploading the brain on the internet. The third part focuses on longevity. It shows why the transhumanist program for the elderly fails.

A Dirac-like equation for a massive field obeying the classical Proca equations of motion (PMO) is proposed in close analogy with Majorana’s construct for Maxwell electrodynamics. Its underlying algebraic structure is examined and a plausible physical interpretation is discussed. The behavior of the PMO equations in the presence of an external electromagnetic field is also investigated in the low energy limit, via unitary transformations similar to the Foldy-Wouthuysen canonical transformation for a Dirac fermion.

A growing body of research suggests that children with autism spectrum disorder are at risk of reading and learning difficulties. However, there is mixed evidence on their weaknesses in different reading components, and little is known about how reading skills characterize in ASD. Thereby, the current study aimed to systematically review the research investigating this function in children with ASD. To this purpose, we reviewed 24 studies that compared children with ASD and children with typical development in word and nonword (...) reading performance, children with ASD and normative data of word and nonword reading tests, and the results obtained by children with ASD in word and nonword reading tests. Most of the comparisons contrasting the reading performance of children with ASD and children with TD did not find significant differences between groups in both word and nonword reading. However, all the comparisons that reported standardized results showed that children with ASD had scores that fell within population norms. Regarding the third comparison of interest, about 54% of the studies presented data for both word and nonword reading, but only one study tested the difference between them and showed that children with ASD had higher levels of word than of nonword reading. Despite these results, the heterogeneous and small samples do not allow to draw sound conclusions regarding the strategies that children with ASD use to read words. As consequence, the nature of reading difficulties presented by children with ASD are still unknown, requiring future research conducted with larger and well-characterized samples of ASD and TD, using homogeneous specific tasks designed to assess word reading strategies. In recent years, the advancements made in the field of neuroscience have been echoed in criminal law, reigniting the discussion on culpability from the viewpoint of if it actually exists, considering the echoes of determinism on the re-found non-existence of free will. This discussion has triggered, once again, the issue of the boundaries and inter-relations between law and science, namely on whether normative or legal concepts and categories should acknowledge scientific breakthroughs. Bringing forth the theme of the limits of the (...) law, this discussion is able to provide insight, with reference to a specific problem, as to whether there are plausible legal answers in the context of the ascription of liability if the subject of law ceases to be a responsible—and thus free—person. Taking into consideration evolution both of science and criminal law dogmatic, we aim to argue that in the particular case of culpability, the desired autonomy of law has its limitations, and that without such limitations the ascription of liability would not have a correct answer. For this argument we will firstly approach the meaning of culpability as a milestone of subjective responsibility in criminal law, so that we can then analyse some arguments made regarding the impact of neuroscience on the maintenance of a concept of culpability with the meaning given above, so that lastly we can proceed to the rebuttal of the overarching impact of science on the law and advocate the autonomy of culpability within the necessary limits imposed by the needs of a plausible legal answer.
